حماية حقوق الملكية الفكرية بين استقطاب الاستثمار الأجنبي المباشر وأداة في التجارة الدولية –مع إشارة لحالة الصين-

Résumé: إن قوانين حماية حقوق الملكية الفكرية تقوم على تشجيع مستويات التجارة والاستثمارات على اختلاف أنواعها وطنية كانت أم أجنبية وذلك من خلال العلاقة بين أنظمة حماية حقوق الملكية الفكرية والاستثمار. حيث أن الكثير من هذه الاستثمارات تحوي شكلا أو أكثر من أشكال حقوق الملكية الفكرية والأسرار التجارية. وتعتبر تجربة الصين من أهم التجارب والتي عملت على تكييف قوانين حماية الملكية الفكرية فيها وفق اتفاقية TRIPS، من أجل استقطاب الاستثمارات الاجنبية الناقلة للتكنولوجيا وتطوير حجم التجارة للمنتجات التقنية. The protection of intellectual property rights is based on the promotion of different levels of trade and investment through the relationship between intellectual property protection and investment systems. Many of these investments contain one or more forms of intellectual property rights and trade secrets. China's experience is one of the most important and has adapted its intellectual property protection laws in accordance with the TRIPS Agreement, in order to attract foreign technology-transfer investments and develop trade volume for technical products.
