نظام البوت (b.o.t) كآلية تعاقدية مستحدثة في مجال الإستثمار وإدارة المرافق العامة

Résumé: ملخص: تهدف هذه الدراسة إلى تأصيل فكرة عقد البوت (BOT) من الناحية النظرية والقانونية، كأسلوب مستحدث لتطوير البنية التحتية وتحقيق التنمية الاقتصادية والاجتماعية، بالإضافة إلى الوقوف على تطبيقات هذا العقد في التشريع الجزائري ومدى اعتماده كآلية للتعاقد في مجال المرافق العامة الضرورية. وقد خلصت الدراسة إلى أن عقد البوت (BOT) يعتبر من أهم الآليات المستحدثة لإنجاز وتشغيل المرافق العامة التي تشكل البنية التحتية في مختلف المجالات، وأن المشرع الجزائري قد تطرق لهذا العقد بصفة ضمنية في إطار الامتياز بموجب العديد من النصوص التشريعية والتنظيمية المختلفة. Abstract: This study aims to rooting the concept of the BOT contract from a theoretical and legal point of view, as an innovative method to develop infrastructure and achieve economic and social development, In addition to Standing on applications of this contract in Algerian legislation and the extent of its adoption as a mechanism for contracting in the field of of necessary public utilities. The study concluded that the bot contract is one of the most important mechanisms innovative for construction and operation of public utilities that constitute the infrastructure in various fields, and that the Algerian legislator has spoken about this contract implicitly in framework the franchise in many different legislative and regulatory texts.
