مظاهر حماية الجنين في الفقه الإسلامي والقانون الجزائري

Résumé: لقد اهتم كل من الفقه الإسلامي والقانون الجزائري بالجنين منذ بداية تكوينه، وعنوا بحياته وشرعوا له من الأحكام ما يكفل استمراره وبقاءه واطراد نموه، من خلال رعاية أمه الحامل به، وذلك بالإنفاق عليها، والترخيص لها في العبادات كالفطر في رمضان، وشق بطنها لإخراج جنينها الحي، كما أُثبت له عدة حقوق جاءت بها الشريعة الإسلامية، وأقرت بها القوانين الوضعية، وهي نوعين من الحقوق: الحقوق غير المالية: وتتمثل في حق الجنين في الحياة وحقه في المحافظة على صحته وحقه في النسب وهي حقوق يراد من خلالها المحافظة على حياة الجنين وكرامته، والحقوق المالية: ويراد بها المحافظة على أموال الجنين وتنميتها؛ وهي: حق الميراث، وكذلك حق الجنين في التبرعات كحقه في الوصية، والوقف، والهبة. Both the Islamic jurisprudence and the Algerian law have concerned the fetus since the beginning of its formation, and they have taken care of his life and made "sharià" laws for the sake of his life preservation and continuation, survival and continuous growth, through the care of his pregnant mother by spending on her and permitting her in acts of worship such as breaking fasting in Ramadaan( no fasting ) as well as the possibility of a cesarean surgery to save her living fetus. In addition to that several rights brought by Islamic law, and approved by the positive law , which are two types of rights: non-financial rights: the right to live and the right to maintain his health and right to descent, these rights are intended to maintain the life and dignity of the fetus, and the second type are the financial rights: has to do with preserving and developing fetal money his inheritance, as well as the right of the fetus in voluntary contributions such as the right to commandment, waqf, and gift .
