الممارسات المنافية للمنافسة: بين الحظر و الاباحة

Résumé: أقرت جل قوانين المنافسة ومن بينها الأمر 03-03 الذي یرمي بالدرجة الأولى إلى ضمان السیر التنافسي للأسواق ، ومنع كل ما يعرقل سيرها الحسن وحمايتها من ما أطلق عليها بالممارسات المقیدة للمنافسة والتي تلحق أثار جسیمة بالسوق، كالاتفاقات والتعسف في الممارسات...، لذا عمد إلى حظر كل ما من شأنه تقييد المنافسة في المادة 14 منه الأمر 03-03 المعدل والمتمم المتعلق بالمنافسة. Most of the competition laws, including order 03-03, which aims primarily to ensure the competitive functioning of the markets, and to prevent all that hinders their good conduct and protect them from so-called anti-competitive practices that have a negative impact on the market, such as agreements and abuse of practices... He therefore banned anything that would restrict competition in Article 14 of it, order 03-03, amended and complementary relating to competition.
