المركز القانوني للضحايا أمام المحكمة الجنائية الدولية

Résumé: شهد الإعتراف بالضحايا تطورا عبر مراحل قبل أن يتم تكريسه بصورة شاملة في نظام روما الأساسي المنشئ للمحكمة الجنائية الدولية. ولأول مــرة في تــاريخ العــدالة الجـــنائية الدوليــة، يمكــن للضــحايا المشاركة في الإجراءات والمطالبة بجبر الأضرار. ويعني هذا أنهم لن يمثلوا كشـــهود فقـــط، بل يمكــنهم أن يعبّـــروا عن وجهة نظرهم و شواغلهم في كافة مراحل الإجراءات. يأتي دور الضحــايا في الإجــراءات أمــام المحكـــمة الجنــائية الدولية ليكمّل جهود المحكمة في معـــاقبة الأفـراد المســؤولين عن أشــد الجــرائم خطورة التي تمس المجتمع الدولي. إن المبــدأ الذي يقــف وراء ذلك هو أنه لا يتم بلــوغ العدالة التــامة إلا إذا تــم الإستــمــاع إلى الضــحايا والتخــفيف من المعاناة التي تعرضوا لها. Recognition of victims went through several steps before been fully consecrated in Rome Statute creating the international criminal court. For the first time in the history for international criminal justice, victims have the right to participate in proceedings and request reparations. This means that they will not only testify as witnesses, but may also present their views and concerns at all stages of the proceedings. The role of victims in International Criminal Court proceedings completes the efforts undertaken by the Court to hold accountable individuals who are responsible for the most serious crimes of concern to the international community. The principle behind this is that the true justice is achieved when voices of victims are heard and their suffering is addressed.
