خصوصية الجريمة المعلوماتية وسُبُلْ مكافحتها في التشريع الجزائري

Résumé: يشهد العالم الحديث تطورا مذهلا في مجال تكنولوجيا الاعلام والاتصال، ولعل من ابرز النتائج السلبية للثورة المعلوماتية الحديثة ظهور جرائم معلوماتية جديدة تستهدف الحواسيب وبرامجها وانظمتها المعلوماتية، ونظرا للخصوصية التي تتميز بها هذه الجرائم المعلوماتية عن نظيرتها التقليدية، فقد عمد المشرع الجزائري على مواجهاتها باليات جديدة عبر سن ترسانة من النصوص التشريعية والتنظيمية الموضوعية والاجرائية لمكافحة الاجرام المعلوماتي بكافة صوره واشكاله. وتسعى هذه الدراسة الى ابراز ماهية وخصوصية الجريمة المعلوماتية، والاليات المعتمدة في التشريع الجزائري لمكافحتها، وتوصلت الدراسة الى ان المشرع الجزائري قد خطى خطوات ايجابية في المجال التشريعي لمكافحة الجريمة المعلوماتية، الا انها تبقى قاصرة ومحدودة نظرا للتطور المستمر والمتنامي لهذه الجرائم. The modern world is witnessing an amazing development in the field of media and communication technology, and perhaps one of the most prominent negative results of the modern information revolution is the emergence of new information crimes targeting computers, programs and information systems, and given the privacy that these information crimes are distinguished from its traditional counterpart, the Algerian legislator has intentionally confronts new mechanisms across Arsenal enact from the objective and organizational and organizational texts to combat information crime in all its forms and forms. This study seeks to highlight what the information crime and the mechanisms adopted in the Algerian legislation to combat it, and the study concluded that the Algerian legislator has taken positive steps in the legislative field to combat information crime, but it remains limited and limited due to the continuous and growing development of these crimes.
