منح الامتياز على الأملاك الوطنية العمومية في التشريع الجزائري

Résumé: ملخص: أقر المشرع الجزائري منح حق استغلال وتسيير الأملاك الوطنية العمومية عن طريق الامتياز بموجب نص المادة 64 مكرر من القانون رقم 08-14 المعدل والمتمم للقانون 90-30 المتضمن قانون الأملاك الوطنية، وذلك بإشراك أشخاص طبيعية و/أو معنوية في إدارة وتسيير الملك العمومي من أجل تخفيف الأعباء المالية عن الدولة وضمان تحقيق التنمية والمنفعة العامة. علاوة على ذلك أخضع المشرع إجراءات استغلال الأملاك الوطنية العمومية محل عقد الامتياز وفقا لكيفيات استعمال مرافق الأملاك الوطنية، دون تفصيل في أحكام هذا العقد ودون التمييز بين مجالات الأملاك الوطنية العمومية، ما يتطلب إعادة تنظيم هذا النوع من العقود في نصوص تشريعية وتنظيمية خاصة باعتباره أحد الآليات المستحدثة والبارزة مؤخرا في المنظومة القانونية. الكلمات المفتاحية: عقد الامتياز؛ الشغل الخاص؛ الأملاك الوطنية العمومية؛ منح الامتياز؛ الملك العمومي. Abstract: The Algerian legislator has established the right to exploit and manage public national property through concession, as stipulated in Article 64 bis of Law No. 08-14, which amends and supplements Law No. 90-30 on national property. This approach involves the participation of natural and/or legal persons in the administration and management of public property to alleviate the financial burden on the state and ensure development and public benefit. Moreover, the legislator has subjected the procedures for exploiting public national property under concession contracts to the modalities of using national property facilities, without detailing the provisions of such contracts or distinguishing between different domains of public national property. This necessitates the reorganization of this type of contract within specific legislative and regulatory texts, as it has recently emerged as a significant and innovative mechanism within the legal system.
