بيع الأملاك العقارية الخاصة التابعة للدولة عن طريق المزاد العلني Selling Real Estate Belonging To The State Through Auction

Résumé: ملخص: الملكية العقارية الخاصة للدولة وبحكم طبيعتها وكذا أهدافها أجاز المشرع الجزائري التصرف فيها بالبيع بشرط ألا تستعمل استعمالا تحرمه الأنظمة والقوانين، وهذا من خلال الوقوف على ضرورة احترام مجموعة من المبادئ الأساسية،( المساواة ، العلانية، المنافسة) التي يجب تكريسها أثناء إجراءات البيع وذلك باعتماد طريق المزاد العلني فهو كطريق أصلي بالنسبة لعمليات البيع التي تجريها الدولة، وتكتسي عمليات البيع بالمزاد العلني أهمية بالغة لكونها من التصرفات التي تقوم على إخراج المال من ذمة الدولة إلى ذمة المشتري أي من رسا عليه المزاد ، وفق إجراءات وشروط وحالات محددة قانونا، و تقوم بهذه العملية أجهزة إدارية أوكل اليها القانون مجموعة من الصلاحيات والاختصاصات كما رتب عن عملها مسؤولية قانونية تتحملها عند مخالفتها لهذه القواعد النظامية Abstract: The Algerian legislator authorized the sale of real estate belonging to the state according to its nature and its goals but with the condition of the use that is not forbidden by the system and law, and this is through the strict respect of a number of essential principles (equality, publicity, competition) to be followed during the sale procedures, by using the sale by auction as it is an original way in the sale operations made by the state. The operations of the sale by auction are becoming more and more important since it is among the ways that contribute to separate the money from the state in favor of the private sector, that means from the one who is chosen by auction, this is according to procedures and conditions which are limited by the law. This operation is carried out by administrative systems legally chosen and which are entrusted with a certain number of carters of reference and assignment of tasks, also, it has a legal responsibility that it will face in the case of violation of these statutory rules.
