التراث الثقافي و حمايته في الجزائر

Résumé: الممتلكات الثقافية أو التراث الثقافي فضلا عن أهميته المعنوية في الحفاظ على الهوية و استمراريتها ثروة ساكنة، يمكن أن يستغل كمورد اقتصادي حي لا يستهان به خاصة في قطاعي السياحة و الصناعة التقليدية، و قد أدركت الدول هذه الحقيقة مؤخرا مما جعلها تبادر باتخاذ جملة من الخطوات العملية للاستثمار في التراث الثقافي، لعل أولاها هي وضع إطار قانوني واضح له و إحاطته بالحماية الموضوعية و الإجرائية اللازمة تبعا لذلك ليتسنى استثماره بسلاسة و حكامة، و هذا ما حاولت الجزائر القيام به منذ سن القانون 98-04 المتعلق بحماية التراث الثقافي، و اعتمادا على المنهجين الوصفي التحليلي، و المقارن سنتتبع مدى نجاحها في هذا المسعى. Being a port of cultural heritage, cultural properties, in a addition to its intangible importance in preserving identity and its continuity, is a static wealth that can be used as amportant economic resource that cannot be understimated, especially in the sectors of tourism and traditional industries and crft.In fact, countries which have realized that recently started to initiate a number of parctical steps in order to invest in cultural heritage. In this regard, the first step involved setting a clear legal framework and surrounding it with the neccessary substantive and procedural protection accordingly so that it can be invested smoothly and judicioiusly. This, in fact, wat Algeria has tried to do since the enactment of Law 98-04 related to the protection of cultural heritage. The present paper highights the succes of this endeavor, using both descriptive and analytical, and comparative approaches.
