Résumé: ملخص: تعتبر مسألة اسناد الحضانة عند اختلاف ديانة الحاضن عن المحضون في الزواج المختلط من أهم وأدق المواضيع القانونية ،سواء بالنظر إلى الفراغ التشريعي حول شرط اتحاد الدين بين الحاضن والمحضون لإسناد الحضانة في التشريع الجزائري أو بالنظر إلى عدم اعتراف الدول العلمانية بشرط التربية الدينية الإسلامية للمحضون المكرس في التشريع الجزائري على غرار تشريعات الدول الإسلامية المستمدة أحكامها من الفقه الإسلامي، هذا ما أدى إلى طرح صعوبات، من شأنها المساس بحق الطفل في الحضانة . :Abstract the devolution of custody when the religion of both guardian and the child one are different within mixed marriage is one of the most important and percise legal questions both in view of the legislative vacuum around the condition of the union of religion between the guardian and the child in order to award custody in Algerian legislation,or in view of the non-consideration of secular countries as a condition of the Islamic religious education of the child consecrated in Algerian legislation Similar to the legislation of Islamic countries whose provisions are derived . from Islamic jurisprudence, This has led to difficulties that would affect the right of custody of the child
