تأثير اختلاف ديانة الزوجين في إسناد حضانة الأبناء

Résumé: يعتبر الزواج المختلط المجال الخصب لتصادم قيم وعادات وتقاليد الزوجين المختلفين في الديانة، وقد نتج عن هذا الزواج العديد من المشاكل عند إسناد الحضانة لأحدهما بعد الانفصال، حيث يثور إشكال حول مدى أحقية الأم غير المسلمة بحضانة أطفالها، ويزداد هذا الإشكال حدة أمام شرط تربية الابن على دين أبيه الذي كرسته الدول ذات المرجعية الدينية مثل الجزائر، فهذا الحكم لا تقره الدول الغربية التي لا تعتد بالحالة الدينية للشخص. فالاعتداد بالحالة الدينية لممارسة الحضانة نتج عنه مشاكل عديدة بسبب الاختلاف الموجود بين قانون الدولة التي ينتمي إليها الأب وقانون الدولة التي تنتمي إليها الأم وكذلك قانون الطفل، إضافة إلى تغيير الدين سواء باعتناق الدين الإسلامي أو الردة، فقد كانت هذه المسائل ذات تأثير كبير على الحضانة. Mixed marriage is a fertile area of conflicts between values, customs and traditions of spouses from different religions; which created numerous problems in the attribution of the custody to one of them after the separation. One of which, is a question of whether a non-Muslim mother is entitled to custody of her children or not? This problem stems from the fact that the son should be raised on the religion of his father as it was established by countries with religious authority, such as Algeria. Religious authority is a system that is not upheld by Western countries which do not consider the person's religious status. in addition to the changing in religion, whether by converting to Islam or apostasy, all these issues had a major impact on custody.
