الاجتهاد التنزيلي في المعاملات المالية المعاصرة في ضوء مقاصد الشريعة و القانون

Résumé: يقدم هذا البحث دراسة تأصيلية في الاجتهاد التنزيلي للمعاملات المالية المعاصرة ، وذلك عن طريق تحقيق المناط و اعتبار الوصف المناسب وفق مقاصد الشريعة و القانون ، و تكمن مشكلة الدراسة التي يهدف هذا البحث معالجتها في:ما هي الضوابط المعتبرة في تحقيق مناط المعاملات المالية المعاصرة سواء في صورتها البسيط أو المركبة ؟ وما مدى التوافق بين مقاصد الشريعة و مقاصد القانون في اعتبار هذه الضوابط ؟. و قد اتبعت الباحثة المنهج الاستقرائي و التحليلي، وبموجبه تم تقسيم خطة البحث إلى مبحثين و مقدمة و خاتمة .ومن أهم النتائج التي توصل إليها البحث : هي اعتبار تحريم الحيل ، و تحقيق مقاصد العقد أثناء هيكلته ، و النظر في مآله .منعا لوقوع ما منع منه المشرع دفعا لمفسدة و تحقيقا لمصلحة . This study has presented a rooting study in the fallen reasoning of the contemporary financial dealings, and that through the achievement of the purposes and the consideration of the appropriate description according tothe fundamentals of the Sharia and the law. And the problematic of the study that this research aimed to treat lies in what are the considered restrains in achieving the purpose of the contemporary financial dealings, either within its simple or compound picture? And to what extent the harmony exists between the fundamentals of the Sharia and fundamentals of the law in regard to these restrains? And the researcher has followed the inductive and the analytical method and in accordance to which the outline of the research was split into two sections and an introduction and a onclusion, and among the most eminent findings the research has arrived to are: the prohibition of scams, the achievement of the urposes of the contract during its framing and the consideration of its fat in order to avoid the occurrence of what the legislator has banned to thrust a corrupt and to gain an interest.
