النهي الذرائعي في المعاملات المالية في المذهب المالكي. - بيوع الآجال نموذجا- دراسة تأصيلية في ضوء مقاصد الشريعة الإسلامية وتطبيقاتها المعاصرة. The Pragmatic Prohibition In The Financial Transactions Upon The Maliki School -future Contracts Model- Rooted Study In Light Of Sharia'a Objectives And Its Modern Applications

Résumé: يعتبر النهي الذرائعي واحدا من أهم الأصول التشريعية والاجتهادية في مذهب المالكية بل وغيرهم تأصيلا أو تفريعا. وقد لجأ الفقهاء وفي مقدمتهم المالكية إلى تحكيم هذا الأصل في كثير من أبواب الفقه ومسائله -وبشكل غالب وظاهر منها مسائل المعاملات المالية وأحكام البيوع-، لارتباط كثير من القواعد الكلية المحكّمة في مسائل المعاملات المالية بالنهي الذرائعي. ونظرا للصلة القوية بين أصل النهي الذرائعي وبين مقاصد الشريعة، فإن هذا البحث حاول إظهار القيمة الاستصلاحية الكبيرة لهذا المسلك الاجتهادي ضمن منظومة أدوات الاجتهاد وآلياته. إذ إن كثيرا من صور المعاملات الحديثة والعقود المستجدة خاصة تلك التي تجريها المصارف والبنوك مما تقوى صلته ببيوع الآجال التي تميز المالكية فيها عن غيرهم بإعمال هذا المسلك الاجتهادي من مثل الصكوك التي تصدرها المصارف للاستثمار، وبيع المرابحة للآمر بالشراء، والمواطأة على التورق وغيرها...، تؤكد أهمية الاحتكام إلى هذا الأصل والاستثمار فيه لتحرير أحكام هذه المعاملات. Abstract: pragmatic forbidding is considered one of the most important discretionary and legislative principles in the Maliki school, and it is the major principle in terms of rooting and branching. Jurisprudents, especially Maliki's, arbitrated this principle in many chapters of fiqh and its matters- mostly in the financial transactions and rules of sale conducts- because of the relatedness of pragmatic forbidding to the fiqh doctrine ( general principles ) that is arbitrated in the matters pertaining to the financial transactions. In regard to the strong connection between the principle of pragmatic forbidding and the higher objectives of Shari'ah, this research attempts to show the grand restorational value of this discretionary approach within a set of discretion and its mechanisms.
