الأصل في الأحكام الشرعية من حيث التعليل وعدمه

Résumé: ملخص: إن مسألة تعليل الأحكام الشرعية من القضايا العلمية ذات الأهمية الكبرى في الدرس الأصولي؛ ذلك لارتباطها الوثيق بمبحث القياس؛ إذ لا قياس من دون علة، ومسألة تعليل الأحكام لها فروع وشعب تناولها العلماء بالدرس والتحليل والنقد، ومن أهم مسائلها مسألة الأصل في الأحكام الشرعية هل هو التعبد أم التعليل؟ فالبحث يهدف إلى الكشف عن حقيقة الخلاف بين العلماء فيما هو الأصل في الأحكام الشرعية عموما؛ هل هو التعليل أو التعبد؟ وما هو الأصل في العبادات من حيث التعليل وعدمه خصوصا؟ Abstract: The case of the reasoning of the Shar’i rulings is one of religiouse issues that great Importance in the fundamentalist stady; because it is closely related measurement, that is why no measure without reason and the issue of explaning judgments has sections and divisions that scholars have dealt with through stady, analysis and criticism, and the most important issues in that case is the origin of Shar’i rulings is whether it is devotion or reasoning? The purpose of this research is to uncover the truth of the difference between scholars in the principles of Islamic Jurisprudence; in what is the origin of the Shar’i rulings is it worship or reasoning generally? And what is the origin of devotions in terms of reasoning and lack thereof especially?
