الطبيعة القانونية لعمليات الأمم المتحدة لحفظ السلام

Résumé: يتناول الموضوع النظام القانوني لعمليات حفظ السلام ببحث أساسها القانوني،حيث تعتبر الطبيعة القانونية للعمليات من أكثر الأمور إثارة للجدل في الفقه القانوني الدولي لعدم شمول ميثاق الأمم المتحدة عليها، فمجلس الأمن الدولي يتولى إنشاء العمليات بتحديد مهمة العملية ونوعها وحجمها ونفقاتها ومدتها ويمنح المجلس الأمين العام للمنظمة الأممية سلطة قيادة العمليات وإدارتها بالتعاون مع قائد القوات الدولية،وقادة الوحدات المشاركة في العمليات،وتبرم الأمم المتحدة مع الدول المعنية بالعمليات إتفاقيات تلخص فيها جميع المسائل المتعلقة بالعمليات بالإضافة إلى الإمتيازات والحصانات التي تمنح لقوات السلام الدولية مع تضمينها إحترامها وتعهداتها بتطبيق القانون الدولي الإنساني على قواتها. The subject discuss the lawful system of peacekeeping operations in search of its lawful bases,whereas the lawful nature of operations considered as one of the most controversial issues in the international lawful doctrine for non comprehension of it in the United Nations engagement. And the international security council assume establishement of operations in assignation the duty of the operation an its sige,kind,costs and duration and the council give the secretary general of the International organization the authority to lead operation and direct it with the help of the leader of the international forces and leaders of the participated units in operations,the united nations approve conventions with the concerned states withoperations summarize in it all issues related with operations,in addition to prévéleges and immunities which given for international peace forces with its inclusion of respect and commitment for practice of international human law over its forces.
