Résumé: ملخص : تحديد زمن الوفاة قديما لم يكن يطرح أي إشكال من الناحية الطبية أو الدينية وحتى القانونية ، غير أن ما أحدثه الطب الحديث من تطور فرض مفهوما جديدا للوفاة ،متمثلا في إعلان الوفاة على أساس موت جذع الدماغ دون انتظار توقف التنفس والدورة الدموية ، و يؤيد هذا المفهوم شريحة واسعة من الأطباء ، باعتبار أن الميت دماغيا يعد المصدر الأول لانتزاع الأعضاء لأجل زراعها لإنقاذ حياة مريض آخر بحاجة إلى تلك الأعضاء . أدى الخلاف حول إعلان الوفاة على أساس موت الدماغ إلى اختلاف في الأحكام المترتبة على الوفاة ، فالذين قالوا إن موت الدماغ يعد موتا قانونيا وشرعيا رتبوا على موت الدماغ الآثار القانونية المترتبة على الوفاة من انحلال زواج وانتقال ميراث إلى ورثته بمجرد موت دماغه دون حاجة إلى انتظار توقف تنفسه ودورته الدموية ، والذين قالوا إن موت الدماغ لا يعد موتا قانونيا ذهبوا إلى موت الدماغ يدخل في مرحلة الاحتضار ولا يترتب على موت الدماغ سوى الأحكام الشرعية والقانونية التي تترتب على فاقد الأهلية ومريض مرض الموت. Abstract: Determining the time of death in the past did not present any medical, religious or even legal problems. but, the development of modern medicine has imposed a new concept of death, by the declaration of death based of the brain stem death the without waiting for the cessation of breathing and blood circulation, and This concept is supported by a wide range of physicians .they consider that the brain dead is the first source of removing organs or tissues for transplantation to save the life of another patient in need of those organs. Controversy in declaring brain death as legal death has led to a difference in the legal implications of death. those who said that brain death is legal death they arranged for the death of the brain the legal effects of legal death , like dissolution of marriage and distribution of inheritance to his heirs as soon as his brain died without the need to wait for a cessation respiration and its blood circulation and those who said that brain death is not considered legal death, they do not arrange for brain death any legal effects of legal death , they said brain death does not result in any legal effects except the legal provisions related to person with lack of legal capacity or person with death illness
