ميراث الخنثى على ضوء المستجدات الطبية

Résumé: من أهم مبادئ الشريعة الإسلامية أنه لا يجوز حرمان أي شخص من الحقوق التي تقررت له، وعلى أساس ذلك فإن ولادة الخنثى لا يعني حرمانه من حقوقه، خاصة حقه في الميراث. وقد اجتهد الفقهاء في هذه المسألة عن طريق إبراز العلامات المحددة لجنسه، وبيان أحكام ميراثه. كما أدى التطور الطبي إلى الكشف عن حقائق علمية، في مسألة ميراث الخنثى، وذلك عن طريق اللجوء إلى عمليات جراحية تسمح بتحديد جنسه، وقد أباح الفقهاء هذا النوع من العمليات الجراحية، التي تلعب دورا هاما في تحديد مركز الخنثى من الوارثين وتحديد نصيبه من التركة. تسعى هذه الدراسة لإبراز دور المستجدات العلمية في ميراث الخنثى، لذلك تم تقسيمها إلى مبحثين: الأول يتناول كيفية إزالة الإشكال في الخنثى على ضوء المستجدات الطبية. أما المبحث الثاني فقد عالج دور الحقائق العلمية في ميراثه. In shariaa, hermaphroditism, the condition of having both male and female reproductive organs, doesn’t deprive the person of his rights; he is a human being and, thus, should inherit. Accordingly, Scholars have derived some rules about this issue, i.e. the inheritance of hermaphrodites, using Hadith and Qiyas. Medical development has also contributed to the matter by offering surgical procedures as a solution to determine the gender, which plays an important role in placing hermaphrodites between heirs and determining his share of inheritance. In this paper, the topic will be covered in two parts: the first one will treat how to determine the gender of the hermaphrodites in the light of medical developments, and the second will deal with the role of scientific facts on hermaphrodites’ inheritance
