التمكين المؤسساتي لذوي الاحتياجات الخاصة بين اتفاقية حقوق الاشخاص ذوي الإعاقة والقانون الجزائري

Résumé: تعرض هذه الدراسة التمكين المؤسساتي لذوي الاحتياجات الخاصة والذي يتضمن تأهيلهم وإدماجهم في المجتمع والتكفل بهم عبر مؤسسات وأجهزة خاصة، والسعي إلى تطبيق النصوص القانونية المتعلقة بهذه الفئة من أجل تمكينهم من حقوقهم الموضوعية، وما إذا كانت المؤسسات التي أحدثتها التشريعات الجزائرية في هذا المجال كافية لتنفيذ مضامين اتفاقية الأمم المتحدة حول حقوق الأشخاص ذوي الإعاقة. ولذلك، تم التمييز بين المؤسسات التي سبقت صدور القانون رقم 02-09 المتعلق بحماية وترقية المعاقين على اعتبار أنه أهم قانون ينظم حقوق هذه الفئة، والمؤسسات المستحدثة بعده. ويبدو أن محاولة تكييف التشريعات الداخلية الوطنية مع اتفاقية حقوق ذوي الإعاقة غير كاف، إما لعدم وجود نشاط عملي واضح لهذه المؤسسات بعد، أو لعدم وجود آليات فعالة لرصد تنفيذ الاتفاقية، مما يستدعي ضرورة مضاعفة جهود الحكومة في تعديل قوانينها وتفعيل نشاط الجمعيات والمجتمع المدني محليا ودوليا. Abstract: This study presents the institutional empowerment of people with special needs into society, and whether the institutions created by Algerian legislation in this field are sufficient to implement the contents of the Convention on the Rights of Persons with Disabilities.Therefore, a distinction was made between the institutions that preceded the issuance of the Disabled Law No. 02-09 on the grounds that it was the most important law regulating the rights of this category, and the institutions created after it. The attempt to adapt national legislations to the Convention on the Rights of Persons with Disabilities appears to be insufficient, either because there is no clear practical activity for these institutions yet, or there are no effective mechanisms to monitor the implementation of the Convention, which calls for the need to redouble the government’s efforts to amend its laws and activate the activities of associations and civil society At the national and international levels.
