إمكانية الوصول لذوي الاحتياجات الخاصة بين اتفاقية حقوق الأشخاص ذوي الإعاقة والقانون رقم 09-02 المتعلّق بحماية الأشخاص المعوقين .

Résumé: الملخص: تعتبر اتفاقية حقوق الأشخاص ذوي الإعاقة من أشمل النصوص الدولية التي عنيت بحماية فئة المعاقين من منظور حقوق الإنسان. كما يعدّ القانون رقم 09-02 المتعلق بحماية المعاقين من أهم النصوص القانونية في الجزائر التي غطّت حماية هذه الفئة أيضا، ما طرح فكرة مدى توافقه مع الاتفاقية في مسألة تمكين ذوي الاحتياجات الخاصة من الوصول إلى البيئة المادية والاجتماعية والاقتصادية والثقافية والمعلوماتية قصد تسهيل إدماجهم في المجتمع ، لاسيما أنه أسبق في وجوده من الاتفاقية، أمام تسابق الدول نحو حماية حقوق الإنسان. و بالرغم من النقائص التي قد يتضمنها هذا القانون فهو خطوة جيدة نحو تمكين المعاقين من حقوقهم الواردة في الاتفاقية، مع ضرورة تدريب المجتمع على كيفية التعامل مع هذه الفئة بمنظور حقوق الإنسان بدلا عن المنظور الاجتماعي Abstract: The convention on the rights of persons with disabilities is the most important international text that dealt with disabilities from a human rights perspective, as well the handicapped protection law N° 09-02 is considered as the most integral text which cover this category; this raises the question of its compatibility with the convention in accessibility to the physical, social, economic and cultural environment, and to information and communication, to facilitate their social reintegration, especially since it is earlier in its existence than the convention, and since states competing in the issue of protecting human rights. In spite of the shortcomings that this law may contain , it was a good step towards enabling the persons with disability to their rights stipulated in the convention , but with necessity to train the society on how to deal with this category from a human right perspective instead of the social perspective.
