الاستدلال في المختصرات الفقهية – القوانين الفقهية لابن جزي أنموذجا- ،reasoning In Jurisprudential Abbreviations - The Jurisprudential Laws Of Ibn Jazi As An Example -

Résumé: ملخص: يعتبر الاستدلال الفقهي منهجا أصوليا تميّزت به المطوّلات الفقهيّة، حيث يجد الناظر فيها تنوع هذه المناهج الاستدلالية بحسب المدارس الفقهية، و أمَّا المختصرات فلا نجد فيها إلا ذكر الفرع الفقهي دون دليله و ذلك لأجل تسهيل حفظ مسائل الفقه و الإحاطة بها، غير أن المتتبع يجد أن بعض المصنَّفات المختصرة استدل فيها أصحابها على بعض المسائل المسطرَّة فيها، و من تلك المصنفات كتابه القوانين الفقهية لابن جزي الغرناطي، فما هي المسائل التي ذكر ابن جزي دليلها في كتاب القوانين الفقهية؟ و انطلاقا من هذا التساؤل جاء هذا المقال هادفا إلى جمع المسائل الفرعية التي ذكر لها ابن جزي أصلها الفقهي في كتابه القونين الفقهية، و من أجل تحقيق هذا الهدف قسمت المقال إلى ثلاثة مباحث؛ الأول : جعلته لترجمة ابن جزي و التعريف بمؤلفه القوانين الفقهية ، و الثاني : خصصته لبيان مفردات البحث و هي : الفقه و الاستدلال، و الثالث: جمعت فيه الاستدلالات الفقهية الفرعية عند ابن جزيّ. Abstract: Jurisprudential Inferencing is considered as a methodological approach characterized by extensive jurisprudential elaborations, where a variety of these inferential methodologies are observed according to schools of jurisprudence. While in summaries, there is only the branch of jurisprudence without its evidence, aiming to facilitate the memorization and comprehensive understanding of jurisprudence. Yet, the diligent reader may find that some concise works wherein their authors provided evidence to certain issues outlined within them. Among these works is Ibn Juzay Al-Gharnati's book “Al-Qawanin Al-Fiqhiyyah”, so what are the issues the author provided evidence for in this book ? Hence, based on this question, this article aims to compile the subsidiary issues for which Ibn Juzay provided evidence in his book “Al-Qawanin Al-Fuqhiyyah” which originate from jurisprudence. To achieve this goal, the article has been divided into three sections: the first one is dedicated to Ibn Juzay’s translation and introducing his book “Al-Qawanin Al-Fiqhiyyah”. The second one is dedicated to explaining the research terms, which are jurisprudence and inference. The third one is dedicated to compiling the subsidiary jurisprudential inferencing according to Ibn Juzay
