التحقيق العقاري كآلية بديلة عن عقد الشهرة لإثبات الملكية العقارية الخاصة - دراسة تحليلية وتقييمية للقانون رقم: 07-02 -

Résumé: رغم تبني المشرع الجزائري لنظام الشهر العيني القائم على المسح العام للأراضي كأساس لتطهير الملكية العقارية بموجب الأمر رقم: 75-74 المؤرخ في: 12/11/1975، إلا أنه لم يهجر تماماً نظام الشهر الشخصي الذي كان سائداً من قبل، لا بل كان في كثير من الأحيان الوسيلة الموازية لتدارك التأخر المسجل في عمليات مسح الأراضي العام، فسن أولاً إجراء لإثبات التقادم المكسب عن طريق عقد الشهرة بموجب المرسوم رقم: 83-352 المؤرخ في: 21/05/1983. لكن النقائص والسلبيات التي كشف عنها العمل به طيلة 23 سنة، أدت بالمشرع إلى إلغائه واستبداله بآلية التحقيق العقاري بموجب القانون رقم: 07-02 المؤرخ في: 27/02/2007. ولئن حقق هذا القانون بعض الأهداف المنتظرة منه، والتي على رأسها تفادي الإشكاليات الناجمة عن العمل بعقد الشهرة والتسريع من الحصول على سندات الملكية وتوسيع نطاق تطهير الملكية العقارية الخاصة، إلا أن إسناد التحقيق العقاري لجهة إدارية وفقدان سند الملكية المسلم في نهاية التحقيق العقاري لذات الحجية التي يحظى بها الدفتر العقاري وإسناد التحقيق العقاري والصلح لعون إداري كانت من أهم العيوب التي اعترت هذا القانون. Although this law achieves some of the expected objectives, foremost among which is avoiding the problems arising from the work of the act of notoriety, accelerating the acquisition of title deeds and ambit expansion of purge private real estate property, but attribution of the real estate investigation to an administrative authority and losing title deed who submitted at the end of real estate investigation the same argument that the real estate book has and attribution of real estate investigation and reconciliation for administrative assistant those most flaws this law.
