الإدارة الحضارية للخلاف الفقهي بإرادة أصول المالكية مراعاة الخلاف ــــ أنموذجا ـــ

Résumé: فالمقال أصولي في منبعه مقاصدي في مصبه فقهي في شواهده حضاري في سياقه، إذ به يبرز أحد صور التعامل الحضاري في إدارة الخلاف الناشئ في الفروع الفقهية بين المالكية وغيرهم،فمحوره أصل من أصول المالكية وهو مراعاة الخلاف، على كونه من الأصول المالكية العقلية والتي تحمل خصال المسالك حين التعامل مع المسائل الفقهية إذ به ينزل منزلة الميزان بين القولين فيرجح كل كفة حسب ثقل كل دليل لقيام المرجح به حينها والذي اقتضى العدول من هذا إلى ذاك والعكس كذلك. فهو آلية شرعية مؤصلة ومؤهلة لاستثمار تلك الثروة الفقهية الهائلة والتي لا يعدم فيها المخرج الفقهي لكثير من النوازل المعاصرة سواء بالتطابق أو التلازم أو التضمن، فهو مؤشر على مدى واقعية أصول المالكية في هذا الباب، وتعاملهم الحضاري مع الخلاف الفقهي فهو تعامل مع المسالة بكل واقعية وفق هذا الأصل أي مراعاة الخلاف مستثمرا الخلاف الواقع في المسألة أصلا. Abstract: The article is a fundamentalist in its source, my purpose is its jurisprudence in its cultural evidence in its context, as it highlights one of the forms of civilized interaction in the management of the dispute arising in the jurisprudential branches between the Malikis and others, its axis is one of the origins of the Malikis and is the observance of the dispute, as it is one of the mental assets that bear the qualities Tracts when dealing with doctrinal issues, as it descends the status of the balance between the two sayings, so that each cuff is weighted according to the weight of each evidence for the likely doing of it at the time, which required the modification of this to that and vice versa. It is a legitimate and inherent mechanism capable of investing that tremendous jurisprudential wealth, in which the juristic outlet is not executed for many contemporary calamities, whether by congruence, concomitance, or implication, it is an indication of the realism of the ownership of the owners in this section, and their cultural dealings with the juristic disagreement as it deals with the issue in all reality according to This principle, i.e. taking into account the dispute, investing the dispute that is already in the matter.
