Résumé: الملخص: تهدف هذه الدراسة إلى البحث في موضوع الدفع بعدم القبول و القول أحد الدفوع الإجرائية المقررة في قانون الإجراءات المدنية والإدارية ذات المصطلحات القانونية الغامضة، مما استعصى على الفقه، بل حتى على التشريع و القضاء أن يضع تعريفا جامعا مانعا له، ومردّ ذلك إلى طبيعته القانونية التي تترنح بين الدفوع الشكلية والدفوع الموضوعية. فهو يقترب في بعض الحالات من الدفوع الشكلية فيما يختلف عن الدفوع الموضوعية ويقترب في حالات أخرى من الدفوع الموضوعية فيما يختلف عن الدفوع الشكلية، ومنه ما يتصل بالنظام العام وما لا يتصل به. Abstract: This study aims to search the subject of the defense of inadmissibility, and the saying is one of the procedural defenses established in the Civil and Administrative Procedures Law with vague legal terms, which eluded jurisprudence, but even the legislation and the judiciary should put a comprehensive definition that prevents it, and this is due to its legal nature that Reeling between formal defenses and substantive defenses. In some cases, it approaches the formal defenses while it differs from the substantive defenses, and in other cases it approaches the substantive defenses while it differs from the formal defenses, including what is related to public order and what is not related to it.
