حماية المستهلك في إطار عقد البيع بالإيجار، Consumer Protection Under The Lease Sale Contract

Résumé: ندرس من خلال هذا البحث عقد البيع بالإيجار باعتباره صيغة من صيغ البيع في الترقية العقارية، التي كرسها المشرع تماشيا مع الطبقة المتوسطة في المجتمع الجزائري، والتي جاء بها المرسوم التنفيذي 01-105 ونظم أحكامها. نهدف بدراستنا هذه لإبراز تدخل المشرع في تنظيم عقد البيع بالإيجار كصيغة لاقتناء المساكن من خلال توضيح ماهيته، وتبيان مدى توفيره لحماية المستفيد في إطار هذا العقد بالتركيز على الالتزامات التي فرضها على عاتق المتعهد بالترقية العقارية، وكذا فرضه لإخضاع العقد للشكل الرسمي. Through this research, we study the lease sale contract as a form of sale in the real estate promotion, which the legislator has enshrined in line with the middle class of Algerian society, and which came out of executive decree 01-105 and its provisions. In this study, we aim to highlight the legislator’s intervention in regulating the lease sale contract as a form of housing acquisition by clarifying what it is, and indicating the extent to which it is available to protect the beneficiary under this contract by focusing on the obligations imposed on the contractor to upgrade the real estate, as well as imposing it to subject the contract official club.
