ضمانات أمن المعطيات الشّخصية المتداولة عبر الإنترنت

Résumé: تعتبر شبكة الإنترنت البيئة المناسبة لعمليات جمع واستعمال وتسجيل المعطيات الشخصية للأفراد، كالبيانات المتعلقة بهوية المستخدم عبر الإنترنت، وتحديد المواقع الجغرافية(GPS)، والبيانات الفيزيولوجية، الجينية، النفسية، الاقتصادية، الثقافية والاجتماعية، حيث تزايد الاستخدام غير المشروع لهذه المعطيات على الشبكة بشكل هائل، على حساب الحقوق والحريات الأساسية للأفراد، وخِدمة لمصالح الأحزاب السّياسية، الشّركات الرّقمية، القراصنة، الخ... وعليه فإنّ ازدياد الهجمات عبر الإنترنت وتطوّر تقنيات الاتصالات الالكترونية، دفع بالدول إلى إعادة النّظر في مفهوم المعطيات الشّخصية والاستعانة بترتيبات تقنية المراقبة الإلكترونيّة على الاتصالات، كآلية إضافية لضمان حرية تنّقل البيانات الشّخصية للأفراد، وترصّد التّهديدات الإلكترونيّة المحتملة التي تمس بسريّة البيانات الشّخصية المتداولة عبر شبكة الإنترنت. The Internet has become an adequate environment for collection operations, and uses personal data registered at unbeknownst to the individual, such as the connection data, and the cordial(GPS), as well as several elements specific to physical, economic, cultural or social, but the extent of the illegal collection of said data significantly increased on the internet, to the detriment of respect for the fundamental freedoms and rights of the persons concerned, for the benefit of political parties, digital companies, hackers, etc. Indeed, the risk of internet attack is real and the process resulting from the technical characteristics of electronic communication, imposes on the state of resorting an additional data protection mechanism, that allows them to use the contemporary surveillance practices of communication on the network, so as to ensure the freedom of movement of personal data, anticipate and counter in parallel any attacks, which threaten the integrity of the transmitted data on the Internet.
