الاضراب في الجزائر "دراسة قانونية"

Résumé: أخضع المشرع الجزائري حق الإضراب لمجموعة من الإجراءات والشروط القانونية التي يجب على العمال الإلتزام بها طبقاً لأحكام القانون 90/02 المؤرخ في 06 فيفري 1990، المتعلق بالوقاية من النزاعات الجماعية في العمل وتسويتها وممارسة حق الإضراب، حيث فرض المشرع بدايةً، إستنفاذ طرق التسوية الودية للنزاع قبل التوقف عن العمل، وبعد إستكمال هذه الطرق ألزم المشرع على العمال أو المنظمات النقابية الأكثر تمثيلاً، إرسال للهيئة المستخدمة إشعار مسبق بالإضراب مع تجنب عرقلة حرية العمل في حال مباشرة الإضراب وغيرها من الشروط، وبتوافر او إنتفاء هذه الشروط تتحدد شرعية الإضراب من عدمه.
