تحديد جنس الجنين طبيا في ضوء الشريعة الإسلامية والتشريع الجزائري

Résumé: أصبح تحديد جنس الجنين من الناحية الطبية ميسورا عمليا وتعمل به الكثير من المستشفيات العالمية، وذلك رغبة في اختيار جنس دون آخر، أو تفاديا لأمراض وراثية تنتقل عن طريق جنس الجنين. تهدف الدراسة إلى معرفة تحديد جنس الجنين طبيا والدوافع التي تؤدي إليها وكيفية تحديد جنس الجنين طبيا، ثم التعرف على الحكم الشرعي من خلال التطرق إلى آراء الفقهاء فيها من مجيزين ومانعين وأدلة كل واحد فيهم، وأخيرا قرار المشرع الجزائري. Abstract : Determining the sex of the fetus from a medical point of view has become practically easy and many international hospitals are working with it, in a desire to choose one gender over another, or to avoid genetic diseases transmitted through fetus’s sex. The study aims to medically determining the sex of the fetus and motives that lead to determine the sex of the fetus medically, then to identify the legal ruling by addressing the opinions of the jurists in it, including those who permit and prevent and the evidence of each one of them, and finally the decision of the Algerian legislator
