إشكالية تكييف نظام تنزيل الورثة في قانون الأسرة الجزائري
Résumé: ملخص: يثير نظام تنزيل الورثة الذي أخذ به المشرّع الجزائري في قانون الأسرة، العديد من الاشكالات الشرعية والقانونية وحتى القضائية، وذلك سواء من حيث مشروعية التنزيل وكذا صحة تكييفه في قانون الأسرة الجزائري، فضلا عن بعض المشكلات العملية المتعلقة بتطبيقه في أرض الواقع من حيث شروطه ومقداره وترتيبه في حقوق التركة وغيرها، وانعكاس كل ذلك على اجتهاد المحكمة العليا الجزائرية. Abstract: The system of inheritance by substitution called "tanzil" that the Algerian legislator has adopted in the family law, raises many legal and judicial problems, both in terms of its legitimacy and its adaptation in the Algerian family law, as well as some practical problems related to its application in terms of its conditions, amount, and arrangement in the rights of inheritance and others, but also the reflection of all that on the jurisprudence of the Algerian Supreme Court.
