دور العامل التاريخي في ظهور العدالة الانتقالية في العالم العربي: المغرب وتونس ضمن إطار مقارن

Résumé: تهدف هذه الورقة إلى الإحاطة بطريقة ظهور العدالة الانتقالية في العالم العربي، وبحث إمكانية الوصول لنتائج وتعميمات نظرية جديدة، وذلك عبر الاستعانة بالمنهج المقارن إضافة إلى النظرية المؤسسية التاريخية. وقد توصل البحث إلى أن العدالة الانتقالية في العالم العربي قد ظهرت نتيجة ظرفين تاريخيين: التبعية للمسار والوضع الحرج؛ أين يمكن للتراكمات الإصلاحية في مجال حقوق الإنسان منح فضاء ولو نسبي للمعارضة للمساهمة في ظهور العدالة الانتقالية. وتعتبر النتائج التي توصلنا اليها في غاية الأهمية لبحث منظور نظري للعدالة الانتقالية في العالم العربي يمنح العامل التاريخي مكانة كبيرة، إضافة إلى إمكانية طرح أسئلة وإشكالات جديدة متعلقة بالموضوع. This paper aims to understand the way transitional justice appeared in the Arab world, and to reaching new theoretical results and generalizations, using the comparative method in addition to the historical institutional theory. The research concluded that transitional justice in the Arab world emerged because of two historical circumstances: the path dependence and the critical juncture. So, the reformists’ accumulations in the human rights’ field can relatively give the opposition to contribute to the emergence of transitional justice. Moreover, the results obtained are very important for examining a theoretical perspective on transitional justice in the Arab world and give the historical factor a great place; with the possibility of asking new questions and problems related to the subject.
