الحق الإستئثاري على براءة الاختراع في اتفاقية تريبس بين مبدأ احتكار الاستغلال والقيود الواردة عليه

Résumé: ملخص: تعتبر براءة الاختراع من أهم حقوق الملكية الصناعية ، لذلك سعت اتفاقية تريبس إلى توفير إطار قانوني فعال يحمي الاختراعات ويحفظ حقوق مالكيها عن طريق براءة الاختراع ، وهذه الأخيرة تعد الوسيلة القانونية لإضفاء الحماية القانونية على الاختراع موضوع البراءة . وتكمن أهمية هذه الدراسة في محاولة الوقوف على ما جاءت به اتفاقية تريبس بخصوص نظام حماية براءة الاختراع وبالتحديد إشكالية الموازنة بين حق المخترع الإستئثاري والشروط التقييدية الواردة عليه ، و نحاول في هذا البحث الوقوف على ملامح الحماية القانونية التي حاولت اتفاقية تريبس توفيرها لأصحاب براءات الاختراع ، للخروج بنتائج تسد النقص وتعالج القصور في اتفاقية تريبس في تنظيم هذا الموضوع . Abstract : Patent is considered as the most important industrial property rights.for this, trips agreement sought to provide an effective legal framework that saves inventions and protects the right of its owners by patent. And the latter is seen to be the legal means for lending the legal protection on the invention the topic of innocence. The importance of this study lies on trying to shed light on the content of trips agreement concerning the system of protecting , and precisely the problematic of making a balance between the right .of the exclusive inventor and the incoming bounden conditions .and we also attempt to caste the light on the features of the legal protection that trips agreement has attempted to make it available for patent owners for coming up with results that fulfill the lack and treats the shortage in trips agreement in the organization of this topic.
