مصطلح : العنف الأسري في اتفاقيات حقوق المرأة وخطورته على دعائم مؤسسة الأسرة في المجتمع الجزائري (في إطار الملتقى الدولي الأطر الحمائية للأسرة ودورها في إستقرار المجتمع )

Résumé: تواجه الأسرة في المجتمع المسلم في وقتنا الراهن تحديات كثيرة تستهدف زعزعة استقرارها وتفكيك أسسها لاسيما من الجانب القانوني ، أين أدى اعتناق الاتفاقيات الدولية لحقوق الانسان للقيم الغربية في مبادئها ونصوصها وانضمام العديد من الدول الإسلامية إليها إلى عمل هذه الأخيرة على مواءمة تشريعاتها الداخلية مع تلك الاتفاقيات ونقلها إلى قوانينها، ومن ضمنها تكريس مصطلحات العنف ضد المرأة لاسيما داخل الأسرة في قانوني الأسرة والعقوبات ، وهو الأمر الذي يثير مسألة التعارض بين مفهوم العنف الزوجي من منظور الاتفاقيات الدولية وبين معالجة الفقه الإسلامي لأسباب الخلاف والنزاع داخل الأسرة انطلاقا من مبدأ المعاشرة بالمعروف. The family in the Muslim community at the present time faces many challenges aimed at destabilizing it and dismantling its foundations, especially from the legal side, where the adoption of international human rights conventions for Western values in their principles and texts and the adherence of many Islamic countries to them led to the latter working to harmonize their internal legislation with those conventions and transfer them to its laws, including the devotion of the terminology of violence against women, especially within the family, in the Family and Penal Codes, which raises the issue of the conflict between the concept of marital violence from the perspective of international conventions and the Islamic jurisprudence’s treatment of the causes of disagreement and conflict within the family based on the principle of "live with them in kindness".
