إعداد النصوص القانونية والأمن القانوني

Résumé: تعتبر عملية إعداد القانون حجر الزاوية في تحقيق الأمن القانوني لأنها تسمح بتحديد مدى جودة ومعيارية القاعدة القانونية وهو ما سيساهم لاحقا في ضمان سلامتها من العيوب التي قد تزعزع استقرار المراكز القانونية المرتبطة بها وما قد ينجم عنه من مساس بحقوق وحريات الأفراد المخاطبين بها. رصد الدستور الجزائري في هذا الصدد العديد من الضوابط سواء من حيث تنظيم قواعد الاختصاص بإعداد النصوص القانونية أو من حيث الإجراءات المتبعة والتي تعد بمثابة ضمانات للحفاظ على جودة القاعدة القانونية. إلا أن هذه الضوابط لا تزال محدودة الفعالية، وهذا راجع لاختلال تنظيم قواعد الاختصاص، وإشكالية النوعية من حيث الإجراءات المتبعة. الأمر الذي يحتاج إلى إصلاحات نوعية. The elaboration of the law is the key to the good realization of legal certainty, it makes it possible to determine the quality of the legal standard, and subsequently to ensure its integrity against the defects likely to destabilize the legal status which are associated with it. Which guarantees the protection of the rights and freedoms of the individuals concerned. In this regard, the Algerian constitution has provided for numerous guarantees, which determine the rules of jurisdiction and the various procedures for the production of legal rules. but the contribution of these mechanisms as a guarantee of legal certainty remains limited. Its low efficiency is due to the imbalance in the regulation of the rules of competence, and to the problem of quality in terms of procedures followed. This requires qualitative reforms.
