أثر فعلية القاعدة الدستورية في تكريس الأمن القانوني. قراءة في الفقه القانوني والفقه الاسلامي.

Résumé: يعتبر الأمن القانوني اليوم من المفاهيم القانونية المطروحة على صعيد البحث القانوني، لما له من أهمية نظرية وتطبيقية على واقع الحياة القانونية من جهة، وطبيعة العلاقات القانونية للمخاطبين بالقاعدة القانونية من جهة ثانية. وحيث أن القاعدة الدستورية هي القاعدة العليا في التنظيم القانونية لكل دولة، فهي تحظى باهتمام كبير في آليات وضعها وتدابير تطبيقها وطرق الغاءها، وعلى اعتبار أنه من مضامين مفهوم الأمن القانوني صحة القواعد القانونية والتي من بينها أساسا القواعد الدستورية، فان فعلية هذه الأخيرة أثر في تكريس المشروعية القانونية من جهة، وتحقيق أحد أوجه الأمن القانوني من جهة ثانية. تبعا لذلك؛ الباحث يطرح مسألة فعلية القاعدة الدستورية وأثرها في تعزيز مبادئ الأمن القانوني، وذلك من خلال المقارنة والمقاربة والنقد في الفقه القانوني والفقه الاسلامي. وذلك من خلال طرح التساؤل التالي: كيف يمكن للقاعدة الدستورية ان تحقق وتكرس الأمن القانوني؟ في الفقه القانوني والفقه الاسلامي؟ Legal security today is considered one of the legal concepts in the field of legal research, because of its theoretical and practical importance to the legal reality of life on the one hand, and the nature of the legal relations of those who address the legal basis on the other hand. Since the constitutional rule is the supreme rule in the legal organization of each State, it is of great interest in the mechanisms of its development and the measures of its application and the methods of its abolition. As one of the contents of the concept of legal security is the validity of the legal rules, Legal legitimacy on the one hand, and the achievement of one of the aspects of legal security on the other hand. Accordingly, the researcher raises the question of the actual constitutional rule and its impact on the promotion of the principles of legal security, through comparison, approach and criticism in the jurisprudence of positive law and Islamic jurisprudence. By asking the following question: How can the constitutional rule to achieve and devote legal security?
