عقود تفويض المرفق العام تجسيد للشراكة بين القطاع العام والقطاع الخاص في الجزائر

Résumé: تعتبر الية تفويض المرفق العام تجسيد حقيقي للشراكة بين القطاع العام والقطاع الخاص في الجزائر، وهناك عدة اعتبارات دفعت السلطات العمومية لتبني هذه التقنية التعاقدية، من بينها عجز الميزانية العامة للدولة عن تمويل المرافق العمومية وكذلك تسييرها، والاستفادة من خبرة ومعرفة القطاع الخاص في تسيير واستغلال هذه المرافق، اضافة لتحسين اداء الخدمة العمومية للمرافق العمومية. تم تكريس الية تفويض المرفق العام في الجزائر بموجب المرسوم 15/247 المتضمن تنظيم الصفقات العمومية وتفويضات المرفق، واكتمل الإطار القانوني لهذه التقنية من خلال المرسوم التنفيذي 18/199 المتعلق بتفويض المرفق العام، والذي فصل في محتوى ومضمون تقويض المرفق العام، لاسيما اشكال التفويض والضمانات اللازمة لنجاحه من الناحية العملية. The mechanism of delegating the public service is a true embodiment of the partnership between the public and private sectors in Algeria. There are several considerations that prompted the public authorities to adopt this contractual technique, including the inability of the state's general budget to finance and manage public services. Benefiting from the experience and knowledge of the private sector in managing and exploiting these services, as well as improving the performance of public services for public services. The mandate of the General Facility in Algeria was established by Presidential Decree 247/15 regulating public transactions and the mandates of the Facility. The legal framework for this technique was completed through Executive Decree No. 199/18 authorizing the Public Facility, which decided on the content and content of undermining the Public Facility, in particular the forms of authorization, and the guarantees necessary for its practical success.
