دور مبادئ التشريع الجنائي الإسلامي في رسم معالم سياسة التجريم والعقاب.

Résumé: لا ينكر أحد ما لمبادئ الشريعة الإسلامية من دور أساسي في تحقيق أمن واستقرار المجتمع، وتقويمها للسلوك الفردي داخله، ولعل التشريع الجنائي الإسلامي يحوز على مكانة كبيرة ضمن دائرة الشريعة الإسلامية، هذا التشريع بخلاف القوانين الوضعية أثبت جدارته واستحقاقه في بعث السياسة الشرعية للجريمة والعقاب بمفهومها الواسع والضيق وذلك قصد رسم خطط تنظيمية عامة وشاملة لجميع سلوكات الفرد في الوسط المجتمعي، ويتعاظم دور هذا التشريع في ظل اضمحلال دور التشريعات الوضعية أين أثبتت عدم نجاعتها وفاعليتها في تبنيها وفي إرسائها لقواعد متينة وأسس صحيحة تقف عندها وتثبت عليها السياسة الجنائية، وقد تطرقت هذه الدراسة إلى مفهوم سياسة التشريع الجنائي الإسلامي من خلال البحث عن قواعدها وخصائصها وإلى مدى تأثيرها بأحكامها في رسم معالم السياسة الجناية.
