التعديل القضائي كآلية لتحقيق التوازن العقدي في ظل الأوبئة العالمية ( فيروس كورونا نموذجا )

Résumé: الملخص: تقوم العملية التعاقدية في جوهرها على حرية الإرادة على أساس أن العقد هو قانون المتعاقدين وهو شريعتهم، و الأصل في هذه العلاقة لا يجوز تعديلها إلا من طرف المتعاقدين، إلا انه ورد استثناء على هذه القاعدة حيث منح المشرع الجزائري القاضي سلطة التدخل في تعديل العقد لإعادة التوازن إليه إذا ما طرأت عليه حوادث استثنائية نجمت عن تفشي أوبئة عالمية، حيث تعتبر الأوبئة واقعة مادية لما لها آثار سلبية على العلاقات القانونية بوجه عام والعلاقات التعاقدية على وجه الخصوص، ترتّب عليها أن تنفيذ الالتزام التعاقدي قد أصبح مستحيلا أو على الأقل صعب التنفيذ ممّا يهدد المدين بخسارة فادحة كان لابد من تدخل القاضي لدفع الإرهاق والضرر اللذين قد يصيبا المتعاقد الضعيف في العلاقة العقدية ألا وهو المدين.
