تنفيذ عقوبة السجن في نظام روما الأساسي

Résumé: إنشاء المحكمة الجنائية الدولية لم يصاحبه خلق مؤسسة عقابية تختص بتنفيذ عقوبات السجن الصادرة عنها؛ لذا كان لابد في هذا المجال الاعتماد على تعاون الدول لتنفيذ حكم السجن. بالرجوع إلى القواعد العامة المتصلة بالتعاون مع المحكمة الجنائية الدولية فإنّ الدول الأطراف في نظام روما الأساسي ملزمة بالتعاون مع المحكمة طبقا لقاعدة "الالتزام العام بالتعاون"، غير أنّه في مجال تنفيذ عقوبة السجن الصادرة عن المحكمة تم الخروج عن هذه القاعدة وذلك باعتماد قاعدة "التعاون الطوعي للدولة". The creation of a punitive institution for the implementation of its prison sentences was not taken into an account when establishmenting the International Criminal Court. Thus, it was highly recommended to rely on state cooperation so as to carry out the prison sentence. While deemingthe genral rules related to the cooperation with the international criminal court, the countries which are parts of the principal system of Roma are complying by working according to the rule of « The genral commitement with cooperation ».Yet, when working on the rule of the excustion of prison sentence by the court, the latter was breached by following the rule of « State voluntary cooperation » instead.
