حماية حقوق الطفل في ظل القانون 15/12

Résumé: ملخص: خطى المشرع الجزائري خطوة كبيرة في مجال المعاملة العقابية بإصداره القانون 15/12 المتعلق بحماية الطفل والذي جاء بعدة ضمانات سواءًا قبل تحريك الدعوى العمومية أو بعدها إلى مرحلة تنفيذ العقوبة، وتسعى هذه الحماية إلى عدم تسليط العقوبة على الطفل الجانح بالرغم من إرتكابه للفعل المجرم بل تسعى أيضًا إلى إدماج الطفل داخل المجتمع مع اتخاذ كافة الإجراءات الكفيلة بتعزيز هذه الحماية والإبتعاد بقدر الإمكان عن سياسة الردع كحل لمشكلة جنوح الأطفال. Abstract: The Algerian legislator took a major step in punitive treatment by issuing Law 15/12 on the protection of the child, which came in several guarantees both before and after the public prosecution. This protection seeks not to impose punishment on the delinquent child despite his committing the criminal act, Also to integrate the child into society and take all measures to strengthen such protection and to avoid as far as possible the policy of deterrence as a solution to the problem of delinquency of children.
