المادة140 مكرر1 من القانون المدني: نظام تعويض احتياطي

Résumé: وفّر مشرعنا الوطني أنظمة قانونية عديدة تهتم بحماية السلامة الجسدية للأفراد، تضمن لهم حقهم في التعويض عن الأضرار الجسمانية التي قد تلحق بهم جرّاء أخطار اجتماعية، مع ذلك، بقيت بعض الفئات من الضحايا دون حماية، ولسدِّ هذا الفراغ، تدخّل مشرعنا باستحداث المادة 140مكرر1 في القانون المدني اثر تعديله في سنة 2005 تضمن تدخل الدولة، بصفة احتياطية، لتعويض ضحية ضرر جسماني في حالات استثنائية ينعدم فيها المسؤول. Our national legislator has provided many legal systems concerned with protecting the physical integrity of individuals, guaranteeing them their right to compensation for the bodily harm that may befall them as a result of social risk, however, some groups of victims remained without protection, and to fill this void, our legislator interfered with the introduction of Article 140 bis 1 in the law The civil servant, as amended in 2005, included the state's intervention, on a temporary basis, to compensate a victim of bodily harm in exceptional cases in which there is no responsible person.
