نظام المصالحة في القانون الجزائري للضرائب The System Of Reconciliation In The Algerian Tax Law

Résumé: مـلخـص: تعد المصالحة في قانون الضرائب إجراء إستثنائي، حيث تلجأ إليه الإدارة الضريبية من أجل إستعادة الأموال بأقل ثمن، والحدّ من إجراءات المتابعة الجزائية، إتجاه المتملّص من الوفاء بالتزاماته، أين يقوم هذا الأخير بتسديد كل المبالغ المتهرّب منها وفق إجراءات تضبطها الإدارة الضريبية. لذلك فإن سياسة المشرع الجزائري المنتهجة بخصوص مسألة الصلح في المجال الإقتصادي عامة والجبائي خاصة، جاءت حفاظا على العلاقات التجارية وتعزيزا لها بإتباع الوسائل الودية لتسوية النزاعات الناشئة بين الخصوم، حتى بعد فض النزاع. لذا جاءت هذه الدراسة من أجل ضبط نظام الصلح في قانون الضرائب، ومعرفة الأحكام المتعلقة بالقواعد الإجرائية اللازمة على المكلف بالضريبة لدفع مستحقاته بأقل الأضرار. Abstract: Reconciliation in the tax code is an exceptional measure. The tax authorities use it to recover funds at the lowest possible costand to limit the consequences of criminal proceedings towards an unseizable person who fails to meet his obligations. The latter will end up paying all evaded amounts in accordance with the procedures regulated by the tax authorities. The Algerian legislature’s policy on economic reconciliation in general, and criminal law in particular, has been to preserve and strengthen trade relations by using amicable means to settle disputes between adversaries, even after the dispute has been resolved. The study was therefore designed to regulate the reconciliation system in the Tax Code and to identify the provisions relating to the procedural rules necessary for the taxpayer to pay his dues to minimum damage.
