مركز قانون القاضي في تنازع القوانين

Résumé: بعد تطور العلاقات الخاصة الدولية و ضمور فكرة الاقليمية التي سيطرت على الفكر القانوني سابقا، وامكانية تقبل دولة ما قوانين أجنبية إلى جانب قانونها أصبح من الضروري وضع قواعد قانونية تضبط هذا التطبيق، هذا ما نجده ضمن قواعد الاسناد التي ترشد القاضي إلى القانون الواجب التطبيق على المراكز القانونية ذات العنصر الأجنبي. ونظرا للطبيعة الازدواجية لهذه القواعد التي قد تعطي الاختصاص لقانون القاضي أو للقانون الأجنبي، وجب البحث ضمنها عن مركز قانون القاضي وتحديد مواطن تطبيقه بالنسبة للقانون الأجنبي. و بعد أن تضمنت هذه الدراسة إجراء موازنة بينه وبين القانون الأجنبي لمعرفة مركز أحدهما بالنسبة للآخر، خلصت أن قانون القاضي يتمتع بمرتبة راجحة ضمن قواعد التنازع لحل المنازعات الدولية الخاصة مقارنه بالقانون الأجنبي ذلك أن قانون القاضي يلقى ثلاث مواطن لتطبيقه ضمن قواعد التنازع في حين أن القانون الأجنبي يلقى تطبيقا راجحا واحدا قد يفقده إذا ما اعترضته عقبات. And after this study included conducting a balance between it and the foreign law to know the position of one of them in relation to the other, it concluded that the judge’s law has a preponderant rank within the rules of conflict for resolving private international disputes compared to foreign law, because the judge’s law meets three citizens to apply it within the rules of conflict while the law A foreigner meets one more favorable application that he may lose if encountered by obstacles.
