منازعات استحقاق المال الموقوف في التشريع الجزائري

Résumé: يترتب على عقد الوقف الصحيح مجموعة من الآثار الهامة التي تغير حقيقته وغايته المقصودة منه ،كما تؤكد وجوده وتضمن له البقاء والاستمرار ،و ذلك بالاعتراف له بالشخصية المعنوية بالتبعية لسقوط ملكية المال الموقوف عن ملك الواقف كما تجعله مستقلا عن مستحقيه،وينقطع حق الواقف والموقوف عليه في رقبة العين الموقوفة،فلا يمكن لأي منهم أن يتصرف في الملك الوقفي بنقضه أو يخل بمقصوده،كما قد يترتب عنه جملة من المنازعات المتعلقة بمحله أو إدارته. سنسعى من خلال هدا الموضوع إلى توضيح جملة من المسائل المتعلقة بالاستحقاق الوقفي انطلاقا من التشريع الجزائري والشريعة الإسلامية،بالإضافة إلى النزاعات التي تنجر عنه ،سواء فيما بين الموقوف عليهم أو بينهم وبين الجهة القائمة على إدارته وتسييره وصرف ريعه.
