عقد الامتياز كالية لاستغلال العقار الفلاحي

Résumé: الملخص: يمثل الامتياز نمط استغلال الأراضي الفلاحية التابعة للأملاك الخاصة للدولة، ويمكن القول أنه عقد إداري يتولى الملتزم بمقتضاه، وعلى مسؤوليته، إدارة مرفق عام اقتصادي واستغلاله مقابل رسوم يتقاضاها من المنتفعين، وهو التعريف المتفق عليه فقها في حين عرفه المشرع الجزائري على أنه عقد تمنح بموجبه الدولة شخصا طبيعيا من جنسية جزائرية حق استغلال الأراضي الفلاحية التابعة للأملاك الخاصة للدولة، وكذا الأملاك السطحية المتصلة بها، بناء على دفتر شروط يحدد عن طريق التنظيم، لمدة أقصاها اربعين سنة قابلة للتجديد مقابل دفع إتاوة سنوية. كما يتطلب عقد الامتياز جملة من الشروط لمنحه منها ما يتعلق بالأرض الفلاحية محل عقد الامتياز، ومنها ما يخص المستثمر صاحب الامتياز، مما يمكن الجزم معه أنه نظام لا يستهان به لاستغلال الأراضي الفلاحية بغية الدفع بعجلة التقدم الاقتصادي إلى أرقى المستويات، للتمكن من مجابهة اقتصاديات الدول الأخرى. Abstract: The concession represents the pattern of exploitation of agricultural land belonging to the private property of the state, and it can be said that it is an administrative contract under which the obligor undertakes, and on his responsibility, the management and exploitation of an economic public facility in return for fees charged by the beneficiaries, which is the definition agreed upon in jurisprudence while the Algerian legislator defined it as a contract under which the state A natural person of Algerian nationality has the right to exploit the agricultural lands belonging to the state’s private property, as well as the surface properties connected to it, based on a book of conditions determined by the organization, for a maximum period of forty years, renewable in return for the payment of an annual royalty. The concession contract also requires a number of conditions for granting it, including what is related to the agricultural land in the concession contract, including what concerns the investor who owns the concession, with which it can be asserted that it is a significant system for the exploitation of agricultural land in order to push the wheel of economic progress to the highest levels, to be able to confront the economies of countries other.
