ضمانات الحق في محاكمة جنائية عادلة أمام المحكمة الجنائية الدولية

Résumé: ملخص: يعتبر الحق في محاكمة عادلة من أبرز الحقوق الأساسية التي يتمتع بها الإنسان على الإطلاق، كما يحظى هذا الحق بأهمية خاصة في إطار الدعوى الجنائية، حيث يشكل وسيلة لا يمكن الاستغناء عنها في حماية حقوق الأفراد وحرياتهم وأمنهم الشخصي التي قد يتم انتهاكها نتيجة لعدم الالتزام بالإجراءات التي تخضع لها هذه الدعوى الجنائية أو نتيجة لتعرض الفرد للعقوبة الجنائية من دون وجه حق، ومن ثم فان هذه الدراسة البحثية تسعى إلى تحديد ضمانات التقاضي ومعايير الحق في محاكمة عادلة الممنوحة للمتهم أمام المحكمة الجنائية الدولية الدائمة، سواء تلك المستمدة من مبادئ الشرعية الجنائية الدولية أو من قرينة البراءة. Abstract The right to a fair trial is one of the most basic rights enjoyed by humans, and this is particularly important in the context of a criminal proceeding, whereby it is an indispensable means of protection of the rights and freedoms of individuals and their personal security, which may be violated as a result of non-observance of procedures governing this criminal proceeding, or as a result of an individual،s unlawfully criminal punishment of unlawfully. This research study seeks to identify guarantees and standards of rights to a fair trial given to the accused before the permanent International Criminal Court, both those derived from the principles of legitimacy of the International Criminal or presumption of innocence.
