حماية المدنيين أثناء النزاعات المسلحة في الفقه الإسلامي والقانون الدولي الإنساني

Résumé: تناولت هذه الدراسة حماية المدنيين أثناء النزاعات المسلحة في الفقه الإسلامي والقانون الدولي الإنساني، هادفة إلى التعرف على ماهية الحرب والمدنيين، وطبيعة هذه الحماية ومظاهرها في الفقه والقانون، حيث تم الوقوف على حقيقة المدنيين وصور حمايتهم وكذلك أخلاقيات النزاعات المسلحة في المفهوم الإسلامي، وعالج البحث رأي الفقهاء والقانون الدولي الإنساني في حماية المدنيين زمن الحرب بنصوص واضحة في كل منهما، وقد ظهر أن كلًا من الفقه الإسلامي والقانون الدولي الإنساني قد اتفقا على عدم التعرض للمدنيين ومن لم يشارك في الحرب بأي صورة كانت، وبأن مسألة تحقيق الحماية لهم هي من المباديء الأساسية التي جاءت هذه التشريعات باحترامه وصيانته وفق مظاهر وتفصيلات وردت في هذا البحث. Abstract This study dealt with the protection of civilians during armed conflicts in Islamic jurisprudence and international humanitarian law, aimed at identifying what war and civilians are, and the nature of this protection and its manifestations in jurisprudence and law, where the reality of civilians and images of their protection as well as the ethics of armed conflict in the Islamic concept were examined, and the research dealt with opinion Islamic jurists and international humanitarian law in protecting civilians in wartime with clear texts in each of them. It has appeared that both Islamic jurisprudence and international humanitarian law have agreed not to subject civilians and those who did not participate in the war in any way, and that the question of achieving protection Yeh them are the basic principles that came to respect legislation and maintenance in accordance with the aspects and details contained in this research.
