احتيال الأطراف على الأجرة في عقد إيجار السفينة على أساس الرحلة

Résumé: الملخص: يعد عقد إيجار السفينة على أساس الرحلة من بين صور عقد إيجار السفينة، فهو العقد الذي يتعهد فيه المؤجر بأن يضع كليا أو جزئيا، سفينة مجهزة و مسلحة تحت تصرف المستأجر، للقيام برحلة أو أكثر، و بالمقابل يتعهد المستأجر بدفع أجرة السفينة، بحيث أنه لا يجوز إدراج شروط في عقد ايجار السفينة تخالف المبادئ العامة للقانون المعمول به. إلا أنه يمكن أن يحصل إحتيال على العقد، عندما يكون منصبا على أجرة السفينة، حتى لو اختلفت الطرق التي يستخدمها المحتالون، فالقصد دائما يكون واحدا وهو القيام بالعديد من المناورات لتخفيض تكلفة النقل مثلا أو إخفاء الطبيعة الحقيقة للبضائع المراد شحنها، فيمكن أن يصدر هذا الاحتيال من طرف المؤجر أو من طرف المستأجر. الكلمات المفتاحية: المؤجر، المستأجر، العقد، الإحتيال، الأجرة، إيجار السفينة على أساس الرحلة. Abstract: The lease of the vessel on the basis of the trip is a contract in which the lessor undertakes to place in full or in part a fully equipped and armed vessel at the disposal of the lessee for one or more journeys. In return, the tenant undertakes to that no conditions may be included in the lease contract of the ship in violation of the general principles of the law in force. However, fraud can get the contract, so that it will be on the ship's fare, even if the methods used by the crooks vary. The intention is always to be one, which is to do many maneuvers to reduce the cost of transportation, for example, or conceal the true nature of the goods to be shipped. So, the fraud can be committed by the lessor or by the lessee.
