التعويض كجزاء إداري في الصفقة العمومية

Résumé: ملخص: يُعدّ التعويض أحد الجزاءات المالية التي يمكن للمصلحة المتعاقدة في الصفقة العمومية توقيعها على المتعامل المتعاقد، عند تقاعسه أو امتناعه أو تأخره في تنفيذ التزاماته التعاقدية التي تربطه بها، ويهدف هذا الجزاء إلى تمكين الإدارة من جبر الضرر الذي لحق بها نتيجة الإخلال بالعقد، دون الحاجة للجوء إلى القضاء، وفقا لما تملكه الإدارة من سلطة لحماية المصلحة العامة. وقد نظم المشرع الجزائري هذا الجزاء ضمن المادة 152 من المرسوم الرئاسي رقم 15-247، المتعلق بتنظيم الصفقات العمومية وتفويضات المرفق العام، والذي ما لا يزال ساريًا إلى حين دخول النصوص التنظيمية الجديدة حيز التنفيذ، وفقا للمرسوم التنفيذي رقم 21-219 في مادته 119 الفقرة الثالثة، وكذا المادة 112 من القانون رقم 23-12 المتعلق بالقواعد العامة للصفقات العمومية. Summary: procurement contract may impose on the contractor when the latter fails to fulfill, neglects, or delays the execution of contractual obligations. This administrative sanction serves primarily to enable the authority to recover damages incurred as a result of the contractual breach, without resorting to judicial proceedings, based on its prerogative to safeguard the public interest. The Algerian legislator has regulated this penalty under Article 152 of Presidential Decree No. 15-247, which governs public procurement and public service delegations and remains applicable until the new regulatory texts, issued pursuant to Law No. 23-12 on the general rules governing public contracts, come into force. This is further reinforced by Article 119, paragraph 3 of Executive Decree No. 21-219 and Article 112 of the aforementioned law
