النظام القانوني للمستهلك الإلكتروني في ظل قانون 18-05

Résumé: الملخص ان السوق الإلكترونية صارت ملاذا مهما للمستهلك على المستوى الوطني و الدولي، لهذا فهو يحتاج للحماية فيها مثل حاجته للحماية في السوق التقليدية ، بل أكثر ، نظرا لخصوصية البيئة المتعاقد فيها و ما تتضمنه من مخاطر للمستهلك ، فعند ولوجه شبكة الانترنت للبحث عن المنتجات التي تلبي رغباته ، يواجه عدة مخاطر يجب حمايته منها كالجهل بمضمون العقد و شخصية الطرف الاخر لانعدام المعاينة المادية ، و كذا خطر الاعلانات المضللة ، مما يجعله عرضة للنصب و الاحتيال ، و عند ابرام عقد الاستهلاك يجب حمايته من الشروط التعسفية بسبب طبيعة هذا العقد الإذعانية ، و أيضا حماية المنتوج محل العقد من الغش و الخداع ، و حماية شكلية العقد و إعطائه القوة الاثباتية اللازمة ، مع حماية بيانات المستهلك الخصوصية من القرصنة بأساليب تقنية كالتشفير ، أما في مرحلة تنفيذ العقد فيجب ضمان الحقوق المكفولة وفقا للقواعد العامة للعقود كالحق في ضمان تسليم المنتوج ، و خلوه من العيوب، و ضمان التعرض، أو الحقوق المستحدثة بنصوص خاصة بحماية المستهلك سواء وطنية او دولية ، كالحق في ضمان سلامة المستهلك وحقه في المطابقة و الضمان ما بعد البيع ، و حقه في العدول و ضمان تحويل آمن لثمن المنتوج، و هذه الحقوق في جميع المراحل يجب أن تدعمها آليات قوية لتفعيلها و تطبيقها ، وزيادة ثقة المستهلك الالكتروني، كالتوثيق الالكتروني، و الهيئات و الجمعيات و المواقع المهتمة بشؤون المستهلك، و القضاء كآخر ملجأ حماية له. Abstract The electronicmarket has becomevery important for the consumer at the national and international levels, soitneeds protection such as itsneed for protection in the traditionalmarket, and more because of the privacy of the environment and the risksit poses to the consumer. The most important of which are: ignorance of the content of the contract and the personality of the other party because of the lack of physical inspection, as well as the risk of misleadingadvertising, whichmakesit liable to fraud and fraud. When the contract of consumption must beprotectedfromarbitrary conditions because of the nature of thiscontract, And protect the formality of the contract and giveit the necessary force of proof, whileprotecting consumer privacy data frompiracy by technicalmethodssuch as encryption. At the stage of execution of the contract, the rightsguaranteed in accordance with the generalrules of contracts, such as the right to guarantee the delivery of the product, Or the rightscreated by consumer protection laws, whether national or international, such as the right to ensure consumer safety, the right to conform and after-sales warranty, and the right to redress and ensuresafe conversion of the productprice. Theserights must besupported by strongmechanisms for their on and application.
