حماية المستهلك من الإشهار الإلكتروني المضلل في ظل قانون 18/05

Résumé: يحتل النظام القانوني للعقد الإلكتروني مكانا متميزًا ومهمًا في مختلف الأنظمة التشريعية، فهو يعبّر عن أهم التصرفات القانونية في تعاملات الأفراد اليومية، وبتطور التجارة الإلكترونية تطورت معها الجريمة الإلكترونية التي تمس المستهلك الإلكتروني في مرحلة المفاوضات، الأمر الذي استدعى توفير حماية قانونية، وهو ما اتجه إليه المشرع الجزائري في قانون التجارة الإلكترونية إلى ضبط حماية كافية من الإشهارات الكاذبة أو المضللة، ومع تبيان الحماية التي فرضها المشرع في التشريعات السابقة لتبيان مدى اهتمام المشرع بحماية المستهلك، وعليه جاء هذا المقال ليعالج التنظيم القانوني للإشهار الإلكتروني في الجزائر لحماية المستهلك. The legal system of the electronic contract occupies a distinct and important place in the various legislative systems, as it expresses the most important legal actions in the daily dealings of individuals, and with the development of electronic commerce has developed with it the electronic crime that affects the electronic consumer in the negotiation stage, which necessitated the provision of legal protection, which is what he turned to The Algerian legislator in the e-commerce law aims to control sufficient protection from false or misleading advertisements, and with the clarification of the protection imposed by the legislator in previous legislation to show the extent of the legislator’s interest in consumer protection, and accordingly this article came to address the legal regulation of electronic advertisement in Algeria for consumer protection.
