Résumé: الملخص: يعد موضوع اللجوء للتحكيم كوسيلة لحل المنازعات في العقود الإدارية الدولية، من الموضوعات الحديثة و التي بدأت مختلف التشريعات توليها إهتماما كبيرا، فلم يعد التحكيم يقتصر على المنازعات الناتجة عن العقود المدنية و العقود التجارية الدولية، بل إتسع مجاله ليشمل المنازعات الإدارية و التي تكون الدولة أو أحد أشخاص القانون العام طرفا فيها بوصفها سلطة عامة. ولقد إختلف التشريع و القضاء حول إمكانية حل المنازعات الإدارية الدولية عن طريق التحكيم. Abstract The topic of refering to arbitration as a mean to solve conflicts in international administrative contracts, is a modern topic, wich legislator,judiciary and administrative jurisprudence began to pay attention to it all over the world, wich arbitration is not confined to civil and international trade conflicts, but it has expanded to include new areas as the case in adminitrative conflicts which the state or one of the public law people is a party, as a public authority.Jurist and jurisprudence differed on the possibility of resolving international administrative conflicts throught arbitration.
